We sold an establishment over 15 years ago to a new tenant. (to cut along story short) because the newer tenant who took over from the premises from us and defaulted on his payments, Wellington pub company are now taking us to court for an overriding lease. Has anyone experienced this before or could explain the procedure?? or does anyone out there have any terms and conditions on the overriding lease?? Wellington Pub was not there to witness my mum to sign the paperwork so I am not sure how this would holdup but any advice would be greatly appreciated.
